1. Acceptance of Terms

Welcome to Hoskins' Private Rides. These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("Customer," "Client," "Passenger," "you") and Hoskins' Private Rides ("Company," "we," "us," "our") governing your use of our professional driver for hire services in Wilmington, North Carolina, and surrounding areas.


By booking, scheduling, or using our transportation services, whether through phone, email, text message, our website, or any other means, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these Terms, you must not use our services.


We reserve the right to modify, amend, or update these Terms at any time. Any changes will be effective immediately upon posting on our website or notification to you. Your continued use of our services after such changes constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically.





2. Service Description

Hoskins' Private Rides provides professional driver for hire services, including but not limited to:


**Point-to-Point Transportation:** Direct transportation from your specified pickup location to your destination within our service area.


**Airport Transportation:** Reliable transportation to and from airports, including Wilmington International Airport (ILM) and other regional airports.


**Special Event Transportation:** Transportation services for weddings, corporate events, concerts, sporting events, and other special occasions.


**Hourly Charter Services:** Reserved driver services for a specified duration, allowing multiple stops and flexible scheduling.


**Corporate Transportation:** Professional transportation services for business meetings, conferences, client entertainment, and corporate events.


**Medical Appointments:** Non-emergency transportation to and from medical facilities, doctor appointments, and healthcare services.


**Custom Transportation Solutions:** Tailored transportation services designed to meet your specific needs and requirements.


Our services are provided within Wilmington, North Carolina, and the surrounding areas. Service availability outside our standard service area may be arranged on a case-by-case basis and may be subject to additional fees.





3. Booking and Reservations

3.1 How to Book

Reservations can be made through the following methods:

• **Phone:** Call us directly to speak with a representative and schedule your ride.
• **Email:** Send us your booking details, and we will confirm your reservation.
• **Text Message:** Text us your transportation needs for quick booking confirmation.
• **Website:** Use our online booking system (if available) to schedule your service.


3.2 Booking Requirements

When making a reservation, you must provide:

• Your full name and contact information (phone number and email address)
• Pickup date, time, and location
• Destination address or location
• Number of passengers
• Any special requests, accessibility needs, or specific requirements
• Preferred payment method


3.3 Advance Booking

We recommend booking your transportation service as far in advance as possible to ensure availability, especially for:

• Airport transportation (minimum 24 hours advance notice recommended)
• Special events and weddings (minimum 48-72 hours advance notice recommended)
• Hourly charter services (minimum 48 hours advance notice recommended)
• Large group transportation (minimum 72 hours advance notice recommended)


While we make every effort to accommodate last-minute bookings, same-day reservations are subject to driver availability and may incur additional fees.


3.4 Booking Confirmation

Once your reservation is received, we will send you a confirmation via your preferred method of communication (phone, email, or text message). This confirmation will include:

• Booking reference number
• Pickup date, time, and location
• Destination
• Estimated fare or agreed-upon rate
• Driver contact information (provided closer to pickup time)
• Any special instructions or notes


Please review your confirmation carefully and notify us immediately of any errors or changes needed.


3.5 Changes to Reservations

If you need to modify your reservation, please contact us as soon as possible. Changes are subject to availability and may result in fare adjustments. We will make reasonable efforts to accommodate your requested changes, but we cannot guarantee availability for modified bookings.


Changes requested less than 24 hours before your scheduled pickup time may be subject to additional fees or may not be possible depending on driver availability and scheduling constraints.





4. Cancellation Policy

4.1 Customer Cancellations

We understand that plans change. Our cancellation policy is designed to be fair to both our customers and our drivers:


**Cancellations Made 24+ Hours in Advance:** Full refund of any prepaid amounts, with no cancellation fee.


**Cancellations Made 12-24 Hours in Advance:** 50% cancellation fee of the total fare. The remaining 50% will be refunded.


**Cancellations Made Less Than 12 Hours in Advance:** 75% cancellation fee of the total fare. The remaining 25% will be refunded.


**No-Show or Cancellation at Pickup Time:** 100% of the fare will be charged. A no-show occurs when the driver arrives at the designated pickup location at the scheduled time and the passenger is not present or does not respond to contact attempts within 15 minutes.


**Special Event and Hourly Charter Cancellations:** Cancellations for special events, weddings, and hourly charter services may be subject to different cancellation terms due to the reserved nature of these services. Specific cancellation terms will be provided at the time of booking.


4.2 How to Cancel

To cancel your reservation, please contact us as soon as possible using any of the following methods:

• Phone: Call us directly
• Email: Send a cancellation request
• Text Message: Text us your cancellation


Please provide your booking reference number and name when canceling. Cancellations are effective upon our receipt and confirmation of your cancellation request.


4.3 Company Cancellations

We reserve the right to cancel your reservation in the following circumstances:

• Severe weather conditions or natural disasters that make travel unsafe
• Vehicle mechanical failure or breakdown
• Driver illness or emergency
• Circumstances beyond our reasonable control (force majeure events)


If we cancel your reservation, you will receive a full refund of any prepaid amounts, and we will make reasonable efforts to arrange alternative transportation or reschedule your service. We are not liable for any consequential damages resulting from cancellations due to circumstances beyond our control.





5. Pricing and Payment

5.1 Fare Structure

Our pricing is based on several factors, including:

• Distance traveled
• Time required for the service
• Type of service requested (point-to-point, hourly, special event)
• Time of day (peak hours, late night, early morning)
• Special requests or requirements
• Tolls, parking fees, and other applicable charges


We will provide you with an estimated fare or agreed-upon rate at the time of booking. For point-to-point transportation, we typically provide a flat rate quote. For hourly services, we charge an hourly rate with a minimum booking requirement.


5.2 Fare Estimates and Final Charges

Fare estimates provided at the time of booking are based on the information you provide and normal traffic conditions. The final fare may differ from the estimate due to:

• Route changes requested by the passenger
• Traffic delays or road closures requiring alternate routes
• Additional stops not included in the original booking
• Extended wait times beyond the included grace period
• Tolls, parking fees, or other charges incurred during the trip


We will inform you of any significant fare adjustments before they are applied whenever possible.


5.3 Additional Fees

The following additional fees may apply:


**Wait Time Fees:** If the driver arrives at the pickup location at the scheduled time and must wait beyond the included grace period (typically 5 minutes), wait time fees of $5 per 15 minutes may apply.


**Additional Stops:** Stops not included in the original booking may incur additional fees of $5 per stop, plus any additional time charges.


**Tolls and Parking:** All tolls, parking fees, and similar charges incurred during your trip will be added to your final fare.


**Late Night/Early Morning Surcharge:** Services requested between 12amand 5am may be subject to a surcharge of 20% of the base fare.


**Peak Hour Surcharge:** Services during peak demand periods (holidays, special events, etc.) may be subject to additional surcharges, which will be communicated at the time of booking.


**Cleaning Fees:** If the vehicle requires special cleaning due to spills, stains, or other damage caused by the passenger, a cleaning fee of $50 to $250 may be charged, depending on the extent of cleaning required.


**Smoking Fee:** Smoking is strictly prohibited in all vehicles. Violation of this policy will result in a $100 cleaning fee.


**Damage Fees:** Any damage to the vehicle caused by the passenger will be charged at the cost of repair or replacement.


5.4 Payment Methods

We accept the following payment methods:

• Credit cards (Visa, Mastercard, American Express, Discover)
• Debit cards
• Cash (for certain services)
• Corporate accounts (for approved business clients)
• Digital payment platforms (Venmo, PayPal, etc., if applicable)


Payment is due at the completion of service unless other arrangements have been made in advance. For corporate accounts, payment terms will be specified in a separate agreement.


5.5 Payment Authorization

By providing your payment information, you authorize us to charge your payment method for the services rendered, including any additional fees that may apply. For credit card payments, you authorize us to keep your payment information on file for future bookings if you choose to create an account with us.


5.6 Receipts

A receipt will be provided upon completion of your service via email, text message, or in person, as requested. Receipts include a detailed breakdown of charges, including base fare, additional fees, and total amount charged.


5.7 Disputes

If you believe there is an error in your charges, please contact us within 7 days of the service date. We will investigate the matter and work with you to resolve any legitimate billing disputes. Disputes must be submitted in writing via email or mail with your booking reference number and a detailed explanation of the disputed charges.





6. Passenger Conduct and Responsibilities

6.1 Expected Conduct

As a passenger using our services, you agree to:


**Treat Drivers with Respect:** Behave courteously and respectfully toward our drivers at all times. Harassment, discrimination, verbal abuse, or threatening behavior will not be tolerated.


**Follow Safety Instructions:** Comply with all safety instructions provided by the driver, including the use of seat belts and other safety equipment.


**Provide Accurate Information:** Provide accurate pickup and destination addresses, contact information, and any special requirements at the time of booking.


**Be Ready for Pickup:** Be present at the designated pickup location at the scheduled time. Drivers will wait for the included grace period, after which wait time fees may apply.


**Respect Vehicle Condition:** Keep the vehicle clean and report any pre-existing damage to the driver before the trip begins.


**Supervise Minors:** If traveling with children, ensure they are properly supervised and secured in appropriate child safety seats (which you must provide unless otherwise arranged).


**Secure Personal Belongings:** Keep your personal belongings secure during the trip. We are not responsible for lost, stolen, or forgotten items.


6.2 Prohibited Conduct

The following behaviors are strictly prohibited and may result in immediate termination of service, denial of future services, and potential legal action:


**Illegal Activities:** Engaging in any illegal activity, including but not limited to drug use, possession of illegal substances, or any criminal conduct.


**Violence or Threats:** Any form of physical violence, threats of violence, or aggressive behavior toward the driver or other passengers.


**Intoxication:** While we provide transportation for individuals who have been drinking, passengers who are excessively intoxicated, unable to care for themselves, or pose a safety risk may be refused service.


**Smoking and Vaping:** Smoking, vaping, or use of any tobacco or cannabis products inside the vehicle is strictly prohibited.


**Weapons:** Possession of firearms, weapons, or dangerous items is prohibited unless you are a law enforcement officer acting in an official capacity and have notified us in advance.


**Property Damage:** Intentional or reckless damage to the vehicle, including but not limited to vandalism, graffiti, or destruction of property.


**Harassment:** Sexual harassment, unwanted advances, or inappropriate behavior toward the driver.


**Excessive Noise:** Creating excessive noise or disturbances that interfere with the driver's ability to operate the vehicle safely.


**Unauthorized Passengers:** Bringing additional passengers not included in the original booking without prior approval.


**Pets:** Unauthorized pets are not permitted unless you have received prior approval and the pet is properly secured in a carrier. Service animals are always welcome and exempt from this restriction.


6.3 Right to Refuse Service

We reserve the right to refuse service to any passenger who:

• Violates these Terms and Conditions
• Engages in prohibited conduct
• Poses a safety risk to the driver, other passengers, or the public
• Has a history of cancellations, no-shows, or payment disputes
• Provides false or misleading information
• Is abusive, threatening, or disrespectful to our staff or drivers


If service is refused or terminated due to passenger misconduct, no refund will be provided, and the full fare will be charged.


6.4 Passenger Liability

You are responsible for any damage to the vehicle or property caused by your actions or the actions of anyone in your party. You agree to reimburse us for the cost of repairs, cleaning, or replacement of damaged property. This includes but is not limited to:

• Interior damage (torn upholstery, broken fixtures, etc.)
• Exterior damage (scratches, dents, etc.)
• Stains or spills requiring professional cleaning
• Smoking or vaping residue requiring odor removal
• Any other damage caused by negligence or misconduct





7. Driver Responsibilities and Standards

7.1 Professional Standards

All Hoskins' Private Rides drivers are required to:


**Maintain Professional Conduct:** Treat all passengers with courtesy, respect, and professionalism at all times.


**Ensure Safety:** Operate vehicles safely, obey all traffic laws, and prioritize passenger safety above all else.


**Maintain Vehicle Condition:** Keep vehicles clean, well-maintained, and in good working order.


**Provide Reliable Service:** Arrive at pickup locations on time and provide efficient, reliable transportation services.


**Respect Privacy:** Maintain the confidentiality of passenger information and conversations.


**Dress Professionally:** Maintain a professional appearance appropriate for a professional driver service.


7.2 Driver Screening

All drivers undergo comprehensive background checks, including:

• Criminal background checks
• Driving record verification
• Employment history verification
• Reference checks
• Drug and alcohol screening


We are committed to hiring only qualified, trustworthy drivers who meet our high standards for safety and professionalism.


7.3 Driver Training

Our drivers receive training in:

• Safe driving practices
• Customer service excellence
• Emergency procedures
• Accessibility and special needs accommodation
• Local area knowledge and navigation


7.4 Reporting Driver Concerns

If you have any concerns about driver conduct, safety, or professionalism, please contact us immediately. We take all complaints seriously and will investigate and address any issues promptly. Your feedback helps us maintain the highest standards of service.





8. Vehicle and Safety Standards

8.1 Vehicle Maintenance

All vehicles in our fleet are:

• Regularly inspected and maintained according to manufacturer recommendations
• Equipped with current registration and insurance
• Cleaned and sanitized between passengers
• Equipped with safety features including seat belts, airbags, and emergency equipment


8.2 Insurance Coverage

Hoskins' Private Rides maintains comprehensive commercial auto insurance coverage as required by North Carolina law, including:

• Liability coverage
• Collision coverage
• Comprehensive coverage
• Uninsured/underinsured motorist coverage


As of July 1, 2025, North Carolina requires minimum liability coverage of $50,000 per person for bodily injury, $100,000 per accident for bodily injury, and $50,000 per accident for property damage. Our insurance coverage meets or exceeds these requirements.


8.3 Safety Equipment

All vehicles are equipped with:

• Functional seat belts for all passengers
• First aid kit
• Fire extinguisher
• Emergency roadside equipment
• GPS navigation systems


8.4 Child Safety Seats

If you are traveling with children who require child safety seats, you are responsible for providing appropriate car seats unless other arrangements have been made in advance. We can assist with installation if needed. North Carolina law requires:

• Children under age 8 and less than 80 pounds must be in a child restraint system
• Children under age 5 and less than 40 pounds must be in a child safety seat


Please ensure you comply with all applicable child safety laws.


8.5 Accessibility

We are committed to providing accessible transportation services. If you require wheelchair-accessible vehicles or other special accommodations, please inform us at the time of booking so we can arrange appropriate transportation. We comply with all applicable accessibility laws and regulations.





9. Liability and Limitations

9.1 Limitation of Liability

To the maximum extent permitted by law, Hoskins' Private Rides' total liability for any claims arising from or related to our services is limited to the amount you paid for the specific service giving rise to the claim.


We are not liable for:


**Indirect or Consequential Damages:** We are not responsible for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost business opportunities, missed flights, missed appointments, or other consequential losses.


**Delays:** While we strive to provide timely service, we are not liable for delays caused by traffic conditions, weather, road closures, accidents, or other circumstances beyond our reasonable control. We recommend allowing extra time for time-sensitive appointments, especially airport transportation.


**Personal Property:** We are not responsible for lost, stolen, damaged, or forgotten personal property. You are responsible for securing your belongings during transportation.


**Third-Party Actions:** We are not liable for injuries or damages caused by the actions of third parties, including other drivers, pedestrians, or passengers.


**Force Majeure:** We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, acts of God, war, terrorism, civil unrest, government actions, or public health emergencies.


9.2 Assumption of Risk

By using our services, you acknowledge and assume the inherent risks associated with motor vehicle transportation, including the risk of accidents, injuries, and property damage. You agree that you use our services at your own risk.


9.3 Indemnification

You agree to indemnify, defend, and hold harmless Hoskins' Private Rides, its owners, employees, drivers, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of these Terms and Conditions
• Your violation of any law or regulation
• Your negligence or willful misconduct
• Damage to the vehicle or property caused by you or anyone in your party
• Claims by third parties arising from your conduct during transportation


9.4 Insurance Claims

In the event of an accident or incident during your transportation, you agree to cooperate fully with any insurance investigation, including providing statements, documentation, and testimony as requested. You authorize us to share relevant information with our insurance carrier as necessary to process claims.





10. Lost and Found

10.1 Reporting Lost Items

If you discover that you have left personal belongings in one of our vehicles, please contact us as soon as possible with:

• Your booking reference number
• Date and time of service
• Description of the lost item(s)
• Contact information


We will make reasonable efforts to locate your lost items and coordinate their return.


10.2 Item Storage and Return

Lost items that are found will be stored securely for up to 30 days. After 30 days, unclaimed items may be donated to charity or disposed of at our discretion. We are not responsible for the condition of items during storage.


If your lost item is located, we will contact you to arrange return. You may be responsible for:

• Shipping costs if you request the item be mailed to you
• A reasonable handling fee for item return
• Pickup from our office during business hours


10.3 Valuable Items

We are not responsible for lost, stolen, or damaged valuable items, including but not limited to:

• Cash, credit cards, or financial instruments
• Jewelry, watches, or precious metals
• Electronics (phones, tablets, laptops, cameras, etc.)
• Important documents (passports, licenses, legal papers, etc.)
• Medications or medical devices


Please ensure you have all your belongings before exiting the vehicle.


10.4 Perishable Items

We are not responsible for perishable items left in vehicles, including food, beverages, flowers, or other items that may spoil or deteriorate.





11. Complaints and Dispute Resolution

11.1 Filing Complaints

If you have a complaint about our services, we encourage you to contact us as soon as possible. We are committed to addressing your concerns promptly and fairly. Complaints can be submitted via:

• Reviewing booking records and communications
• Interviewing the driver and any witnesses
• Examining vehicle records and GPS data
• Reviewing any available video or photographic evidence


11.3 Resolution Process

We will work with you in good faith to resolve complaints fairly and reasonably. Depending on the nature of the complaint, resolution may include:

• Apology and explanation
• Service credit or refund
• Corrective action with the driver
• Policy or procedure changes
• Other appropriate remedies


11.4 Dispute Resolution and Arbitration

If we are unable to resolve a dispute through our complaint process, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New Hanover County, North Carolina.


You agree to waive your right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought on an individual basis.


11.5 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts of New Hanover County, North Carolina.





12. Intellectual Property

12.1 Trademarks and Branding

"Hoskins' Private Rides" and all associated logos, trademarks, service marks, and branding are the exclusive property of Hoskins' Private Rides. You may not use, copy, reproduce, or display our trademarks or branding without our prior written consent.


12.2 Website and Content

All content on our website, marketing materials, and communications, including text, graphics, logos, images, and software, is the property of Hoskins' Private Rides and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.





13. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of your information as described in our Privacy Policy.

• We collect personal information necessary to provide transportation services
• We use your information to fulfill bookings, process payments, and improve our services

14. Special Services and Accommodations

14.1 Accessibility Services

We are committed to providing accessible transportation for passengers with disabilities. If you require wheelchair-accessible vehicles, assistance with mobility devices, or other accommodations, please inform us at the time of booking. We will make reasonable efforts to accommodate your needs.


14.2 Medical Transportation

While we provide non-emergency medical transportation to and from medical appointments, we are not a medical transport service and our drivers are not medical professionals. If you require medical monitoring, specialized medical equipment, or emergency medical services, please contact appropriate medical transportation providers.


14.3 Pet Transportation

Service animals are always welcome in our vehicles at no additional charge. For non-service pets, please contact us in advance to arrange pet-friendly transportation. Pets must be:

• Properly secured in a carrier or on a leash
• Well-behaved and under your control at all times
• Clean and free of fleas or parasites


Additional fees may apply for pet transportation. You are responsible for any damage or cleaning required due to your pet.


14.4 Luggage and Cargo

We can accommodate reasonable amounts of luggage and personal items. For large amounts of luggage, oversized items, or special cargo, please inform us at the time of booking to ensure we can provide an appropriate vehicle.


We are not responsible for damage to luggage or cargo during normal transportation. Fragile or valuable items should be properly packed and secured. We reserve the right to refuse transportation of hazardous materials, illegal items, or cargo that poses a safety risk.





15. Corporate and Business Accounts

15.1 Corporate Account Setup

We offer corporate accounts for businesses requiring regular transportation services. Corporate accounts provide:

• Simplified billing and invoicing
• Dedicated account management
• Priority booking and service
• Customized reporting
• Flexible payment terms


To establish a corporate account, please contact us to discuss your needs and complete our corporate account application.


15.2 Corporate Account Terms

Corporate accounts are subject to additional terms and conditions, including:

• Credit approval and payment terms
• Minimum usage requirements
• Authorized user designations
• Billing and payment schedules
• Account review and renewal procedures

16. Gift Certificates and Promotional Credits

16.1 Gift Certificates

We may offer gift certificates for our services. Gift certificates:

• Are valid for the amount stated on the certificate

• Are non-refundable and cannot be redeemed for cash
• Cannot be replaced if lost or stolen

16.2 Promotional Credits and Discounts

We may offer promotional credits, discounts, or special offers from time to time. Promotional offers:

• May have expiration dates or usage limitations
• Cannot be combined with other offers unless specifically stated

17. Termination of Service

17.1 Termination by Customer

You may discontinue use of our services at any time. If you have an account with us, you may request account closure by contacting us. Any outstanding balances must be paid before account closure.


17.2 Termination by Company

We reserve the right to terminate or suspend your access to our services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms and Conditions
• Fraudulent or illegal activity
• Abusive or threatening behavior
• Non-payment or payment disputes
• Repeated cancellations or no-shows
• Any conduct that we determine, in our sole discretion, to be harmful to our business, drivers, or other customers


17.3 Effect of Termination

Upon termination:

• Your right to use our services immediately ceases
• You remain responsible for any outstanding payments
• Provisions of these Terms that by their nature should survive termination shall survive, including liability limitations, indemnification obligations, and dispute resolution procedures





18. Miscellaneous Provisions

18.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Hoskins' Private Rides regarding our services and supersede all prior agreements, understandings, and communications, whether written or oral.


18.2 Severability

We are not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, war, terrorism, civil unrest, labor disputes, government actions, public health emergencies, or failures of third-party services or infrastructure.
